Terms for using Estaray AI image generation services

These Terms of Service govern your use of Estaray, including AI image generation, account features, credits, payments, and generation history.
Estaray is actively developed; features may be added, modified, or removed over time, and certain features may be marked as experimental or beta. Material changes to subscription pricing or per-generation credit costs follow the notice rules in §6.
You must be at least 18 years old to use Estaray. By using the service, you represent that you have reached the age of majority in your jurisdiction and have the legal capacity to enter into these Terms.
We do not knowingly provide services to individuals under 18. If we learn that an account belongs to a user under 18, we will terminate it. If you are a parent or guardian and become aware that a minor has created an account, please contact us at support@estaray.com.
We may ask you to confirm your age or eligibility where required for legal, safety, or compliance reasons.
You are responsible for keeping your account secure and for using Estaray lawfully. You may not use the service to abuse infrastructure, violate rights, bypass safeguards, or generate content that is illegal under applicable law.
Anonymous trial without account. Estaray offers a limited trial without an account; trial generations are watermarked. Registering an account from the same browser session preserves your trial generations to your account; see §8 for ownership and watermark details.

We may use automated and human review to detect violations and enforce these Terms. Where we restrict, remove, or suspend content or accounts, we will provide notice and a reason where legally and practically appropriate. You may contact support@estaray.com to appeal a decision.
A regeneration is a re-run of the same generation using the same uploaded photo, the same Estaray feature, and the same prompt set. Regenerations within these constraints are free under your plan's fair-use limits. If you upload a different photo, switch to a different feature, or change any user-provided text, that is a new generation and a Photo Credit may be consumed. Within the Virtual Staging feature, switching room type or style does not consume an additional credit; these are part of the same generation context.
Estaray reserves the right to evaluate and limit unusual usage patterns, including but not limited to:
Specific thresholds and detection criteria are dynamically adjusted by Estaray based on system load and observed user behavior and are not publicly disclosed.
Estaray offers a Free plan with no subscription charge. Paid subscription
plans are Solo, Producer, Premier, and Estate, each available
monthly or yearly. Subscriptions renew automatically unless cancelled before the
next billing cycle. You can cancel through your account settings or, if
unavailable, by contacting support@estaray.com.
A one-time Try Pack credit package is also available for purchase. Other credit packages may be offered in the future; only the Try Pack is enabled at the effective date of these Terms.
Credit types. Estaray uses two credit types:
Price and service adjustments. Prices and per-generation credit costs are not permanent commitments. We may adjust them for legitimate reasons such as changes in service costs, upstream supplier fees, taxes, or regulatory requirements. Material adjustments will be announced at least 30 days in advance through email or in-product notice. New prices apply only at renewal or to new purchases; current billing periods and unused credit packs purchased before a price change are not affected.
Plan changes and cancellation. You can upgrade, downgrade, or switch between monthly and yearly billing at any time through our payment provider's customer portal.
You can cancel your subscription at any time through the customer portal. Cancellation takes effect at the end of your current billing period — you retain access and credits until then. We do not issue refunds for unused time on the current period. Any remaining account balance with our payment provider continues to be governed by their rules and may be applied to future invoices if you resubscribe.
You are responsible for the prompts, reference images, and generated outputs you create or upload. Estaray may limit or remove access when required for safety, abuse prevention, or legal compliance.
Estaray retains the right to use generated images internally for service operation, abuse prevention, and quality monitoring; we do not use your prompts, reference materials, or generated outputs to train our own AI models.
Copyright concerns. Copyright concerns about content available through
Estaray may be sent to support@estaray.com. Include enough information for us
to locate the material and understand the rights issue. We may remove or
restrict access to content where we believe it is appropriate for legal, safety,
or policy reasons.
Subject to your compliance with these Terms, you retain ownership of the prompts and reference materials you provide, and you receive ownership rights to the outputs we generate for you. Outputs fall into one of two categories based on whether a paid Photo Credit was consumed:
If a paid generation does not complete successfully, the Photo Credit consumed for that attempt is automatically returned to your account balance. We may make multiple attempts on your behalf before declaring the generation failed; those attempts are not counted as separate generations. Trial attempts (without an account) are part of a limited daily quota and are not separately refunded.
Estaray offers a 7-day refund window for first-time purchases. Within this window, you may request a refund regardless of how much of the service you have used; however, your actual usage during the window will be deducted from the refundable amount.
Billable usage is calculated as follows: each photo you upload counts as 1 billable photo, and every 5 regenerations of an existing photo count as 1 additional billable photo. (Regenerations do not consume a Photo Credit during normal use, but they do consume service resources and are therefore billable for refund-calculation purposes.)
Per-photo cost is the purchase price of your subscription or credit package divided by the photo allowance included in that purchase for the current billing period.
Refund amount is calculated as:
the purchase price you paid − (billable usage × per-photo cost) − any taxes paid on the purchase − a payment processing fee, equal to the amount retained by our payment processor under its public fee schedule for the original transaction
If the deductions equal or exceed the original purchase price, no refund is due. Otherwise, the remaining amount is refunded to the original payment method.
Refunds will not be granted for:
Subscription fees cover the full billing period and are not refunded for unused time. As described in Section 6, upgrades take effect immediately (with the price difference charged for the remainder of the current period); downgrades, switches from yearly to monthly billing, and cancellations take effect at the end of your current billing period — you keep your current plan's access and credits until then, and we do not prorate or refund the unused portion of a period you have already paid for. This does not limit the first-time purchase refund (§9.2) or automatic credit refunds for failed generations (§9.1).
Initiating a chargeback or payment dispute without first contacting
support@estaray.com may result in immediate suspension or permanent
termination of your account. If a chargeback is successful, Estaray reserves the
right to:
Service "as is". Estaray is provided on an as-available, as-is basis. AI-generated content can vary in quality, accuracy, and appropriateness, and may occasionally produce errors, biased, or unexpected results. We make no warranties beyond those required by applicable law, and we do not guarantee that any specific prompt will produce a specific output, that the service will be uninterrupted, or that all generated content will be free from defects.
No guarantee about generated outputs. We do not guarantee that generated outputs will be unique, copyrightable, free of third-party rights, suitable for professional use, or compliant with the policies of any specific platform, marketplace, or advertising channel. Estaray does not provide legal, medical, financial, or other professional advice.
Limitation of liability. To the maximum extent permitted by applicable law, Estaray shall not be liable for any damages arising out of or relating to these Terms or your use of Estaray — including direct, indirect, incidental, consequential, special, or exemplary damages — regardless of cause or legal theory.
You acknowledge that Estaray outputs are produced by automated AI systems that involve significant inherent variability, that no specific output is guaranteed to be suitable for any particular use case, and that you alone are responsible for evaluating whether any Estaray output is appropriate for your intended use (including but not limited to commercial use, real-estate listing publication, marketing communication, or any other purpose).
Estaray makes only a best-effort commitment to produce reasonable outputs from the inputs you provide; we do not warrant that outputs will match your expectations, your reference materials, or any specific external standard.
Mandatory protections preserved. Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for gross negligence, willful misconduct, fraud, or death or personal injury caused by negligence. Where applicable consumer protection laws provide stronger rights, those rights prevail.
Note: This section covers account-level suspension and termination for violations of these Terms. For temporary usage limits applied specifically to abuse patterns (high-frequency regeneration, automation, account sharing, etc.), see §5.2.
Termination by us. We may suspend or terminate your account if:
Where the situation allows, we will provide notice and a chance to remedy before termination.
Termination by you. You may close your account at any time through your account settings or by contacting support@estaray.com. Closing your account does not by itself trigger a refund. Except where applicable law requires otherwise, unused credits in a closed account are forfeited. Any refund request will be evaluated under the Refunds terms.
Termination without cause. If we terminate your account without cause or discontinue the service, we will handle unused paid credits in accordance with the Refunds section and applicable law.
Reactivation. We may, at our discretion, reactivate a closed or terminated account upon request. Reactivation is not guaranteed, particularly where the account was terminated for violations.
Data after termination. After termination, your data is retained or deleted according to our Privacy Policy. You may also exercise data deletion rights available under applicable data protection laws.
We may update these Terms from time to time. For material changes, we will provide at least 30 days' advance notice through email or in-product notification before the changes take effect. Non-material changes (such as typo corrections, formatting, or clarifications that do not affect your rights or obligations) may take effect immediately upon posting.
If you do not accept the updated Terms, you may close your account or cancel your subscription before the changes take effect, in line with our Termination and Refunds sections. Continued use of Estaray after the effective date of the updated Terms constitutes your acceptance of those Terms.
Where applicable law requires separate consent for a particular change, we will seek that consent separately.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. The exclusive jurisdiction and venue for any dispute arising out of these Terms is the state and federal courts located in Delaware, USA.
Estaray is provided on an as-available basis. AI generation results can vary, and we do not guarantee that every prompt will produce a specific output.

Estaray operates a referral program and may from time to time run promotional campaigns. Types of promotional mechanisms we may use include:
Specific promotional codes, eligibility criteria, and expiry terms are stated at the time of issuance. Codes may be modified or withdrawn at our discretion, are not exchangeable for cash, and are not combinable unless explicitly stated.
Estaray outputs are designed for real-estate listing workflows. However, MLS rules and disclosure requirements vary by jurisdiction and platform. We do not certify the MLS compliance of any specific output, and we make no representation that any particular MLS or local regulation will accept a given image.
Where MLS or local regulation requires disclosure that an image is virtually staged, you are responsible for adding the appropriate disclosure (such as a "Virtually Staged" label) to the image or the associated listing. Estaray may provide tools to add such labels but does not guarantee that any specific marking will satisfy any specific market's rules.
